July 22 Florida Man Who Killed Unarmed Man Over a Parking Space Won’t Be Arrested

The man who shot another man during a parking fight will not be arrested or charged, Florida police said.

Michael Drake, 47, was dumped by Marquis McGlockton on Thursday after colliding with his girlfriend parked in a disabled garage.

Drake then shot Mr. McGlockton in the chest while still on the ground.

Police say they didn’t arrest Mr. Drake because of state law to “stand their ground” or “shoot first.”

The law provides protection from criminal prosecution or civil liability for individuals who claim self-defense following a shooting or violent incident. “I do not accept the law. I enforce the law, ”Pinellas County Sheriff Bob Gualtieri told a news conference Friday. …

“I’m going to enforce this way of writing. Others may argue about whether they like it or not. ”

He said the case would be reviewed by a state attorney who would determine whether or not Mr. Drake should be charged.

But the lawyer had to provide “clear and convincing evidence that [he] had no right to use force,” the sheriff said.

The footage of the shooting was recorded on a security camera outside the convenience store and shows McGlockton rushing back into the building, clutching his chest.

Eyewitnesses say he fainted before buyers called emergency services. He was taken to a hospital in Clearwater and pronounced dead.

Police say Mr. Drake cooperated when they arrived and had a valid hidden weapon license.

The Advocate Your Positions law came under scrutiny after an unarmed teenager was shot and killed in 2012. George Zimmerman, a neighborhood watchman, shot Trayvon Martin as he was returning from a store in Sanford.

Florida police cited the law after they released Zimmerman without charge on the night of the shooting.

But more than 480,000 people signed a petition calling for him to be brought to justice. He was eventually brought to trial, but was found not guilty of all charges.
